Docs: Child injured during Kokomo man's intoxicated tirade

DELAWARE COUNTY, Ind. - An allegedly intoxicated Kokomo man's outburst left a child injured over the weekend.

According to court records released Monday, police were called to the 2800 block of East 16th Street in Muncie around 8:27 a.m. Sunday. When officers with the Muncie Police Department arrived at the scene, they located Mark Scott II - a 31-year-old Kokomo man.

Police reported that Scott was wearing his pants backwards when they found him. They also observed that Scott exhibited unsteady balance and slurred speech.

After finding Scott, police spoke with other members of his family. Those family members indicated that Scott was extremely intoxicated and agitated.

Family members told police that, during an outburst, an allegedly intoxicated Scott picked up a 1-year-old child and threatened to pack up and leave with the juvenile.

Scott's family attempted to calm him down and talk him out of leaving with the child. During that conversation, according to court records, Scott picked up a pipe wrench, began swinging it around and threatened his family. The 1-year-old was in Scott's arms while he was swinging the wrench.

At some point during Scott's tirade, a member of his family grabbed the wrench he was wielding and attempted to take it from him. During the struggle for the wrench, the 1-year-old was hit in the head.

Police reported that the juvenile had two large abrasions on his head and two smaller abrasions on his chest and left arm.

Scott's family members indicated that, after the struggle for the wrench, Scott took the child to a car and put him in the back of it. Court documents indicate that Scott did not leave as planned because he had to go back inside and retrieve his keys.

When Scott left to get his keys, a member of his family grabbed the child - who had been left alone in the car - and sat at a neighbor's nearby home until police arrived at the scene.

Scott has been preliminarily charged with neglect of a dependent, a Level 5 Felony, and criminal recklessness - a Class A Misdemeanor.

In Indiana, the maximum penalty for a Level 5 Felony like neglect of a dependent is a six-year prison sentence and a fine of up to $10,000.
