Docs: Greenwood man assaulted father, tried to run over him following dispute

GREENWOOD, Ind. -- A Greenwood man has been charged with criminal recklessness, intimidation and other counts after police say he attempted to run over his father.
According to court documents obtained by FOX59/CBS4, 32-year-old Dustin Emmert-Stamm faces the following preliminary charges:
- Intimidation with a Deadly Weapon (Level 5 Felony)
- Criminal Recklessness Committed with a Deadly Weapon (Level 6 Felony)
- Intimidation (Class A Misdemeanor)
- Domestic Battery (Class A Misdemeanor)
- Disorderly Conduct (Class B Misdemeanor)
- Reckless Driving (Class A Misdemeanor)
- Criminal Mischief (Class A Misdemeanor)
- Three counts of Leaving the Scene of an Accident (Class B Misdemeanor)
Investigation, arrest
On Aug. 17, officers with the Greenwood Police Department responded to a reported disturbance at a home located on Traditions Pass. While officers were en route, one of them reported seeing a man wearing pink shorts and no shirt in a black 2023 Chevrolet Silverado. The officer said the vehicle was driving recklessly and rammed into nearby vehicles.
As the officer arrived on the scene, he recalled seeing the same man, who police identified as Emmert-Stamm, running toward his fully marked police vehicle while waving his hands into the air.
The two officers exited their vehicles and ordered the suspect to stop running and get on the ground. Emmer-Stamm complied and rolled to his stomach while lying down. Officers detained him as they worked to unravel what type of disturbance had occurred.
Police then met and spoke with the victim, who court documents confirmed was Emmert-Stamm's father, who told them that his son had allegedly crashed into his personal vehicle.
Officers noted that the victim had several cuts on his face and arms, as well as a mark on his right eye. The victim stated that he sustained the cuts while attempting to climb over a fence in a bid to avoid Emmert-Stamm.
Court documents show that officers learned the father and son were providing lawn care at a residence in the area and painting a room inside the home. The victim said he and Emmert-Stamm got into a physical altercation
The responding police then turned their attention to Emmert-Stamm to learn his side of the story. Emmert-Stamm claimed his father had tried to kill him, and that he "blacked out" during the incident. He shared that he and his father were at the residence to perform contractor work together.
He went on to state that he cut the grass and used a weedwacker on the lawn while his father went to put gas in his truck. Emmert-Stamm said his father yelled at him about the grass not being cut when he returned from the gas station.
This led to a verbal altercation, according to Emmert-Stamm. Afterward, he claimed his father "beat him up" and threatened to kill him. After the fight ended, Emmert-Stamm said he did not know how he got outside and that he "must have blacked out" while stating that he didn't recall the accident taking place.
As they spoke with the suspect, they recalled observing a "white substance" in both his beard and his mouth, court documents said.
As officers pressed him for more information about the incident, court documents show Emmert-Stamm began to remember more events. He said he got into his truck and began driving north on Traditions Pass. A short time later, the crash occurred. Emmert-Stamm said this was not intentional and that he did not mean to run into his father's truck, trailer or attempt to run over him.
During their questioning, police said Emmert-Stamm began screaming after he was placed into a Greenwood police jail van.
'It wasn't intentional': Emmert-Stamm's interview
However, court documents included a witness's account that appeared to contradict Emmert-Stamm's version of events. The witness told police that he observed Emmert-Stamm and his father physically fighting in a yard on Traditions Pass.
The witness said the suspect's father approached and asked him to contact 911. As he was doing so, the witness recalled seeing Emmert-Stamm approach and throw "Superman punches" while allegedly assaulting his father.
Emmert-Stamm then reportedly ran around the neighborhood before coming to a halt in the middle of the street, where he laid down and began rolling around. He then allegedly entered his black truck and backed into his father's vehicle before driving north on Traditions Pass "at a high rate of speed," the witness said.
The witness recalled Emmert-Stamm turning around and striking his father's vehicle. The witness also said it appeared that Emmert-Stamm was allegedly attempting to run over his father "as if he was trying to kill him."
The witness added that Emmert-Stamm had struck his father's vehicle so many times that it became disabled.
Police also sifted through video footage that captured the alleged incident. The video appears to show the victim running behind his vehicle to avoid being struck by Emmert-Stamm, court documents said.
Court documents said another individual corroborated the witness's statements.
Father's account
In a follow-up interview with the suspect's father, he disclosed to police that he believed Emmert-Stamm "had been wanting to snap for about two weeks" as he had been living out of his truck.
He claimed his son was upset with him because he declined his requests for money, saying he did not have the extra money available to give. He said he then shared his location with Emmert-Stamm so he could help him do contractor work.
He recalled that Emmert-Stamm arrived at the residence with an "aggressive" attitude. While he was painting a room on the second floor of the home, the victim said Emmert-Stamm came in to help. He said an argument erupted after he told Emmert-Stamm he was not painting the wall correctly.
He said his son left the room before reentering it a short time later. He allegedly grabbed his father by his left shoulder near his neck in what he believed was an attempt to choke him, according to court documents.
As the altercation continued, the father said he believed Emmert-Stamm was trying to throw him out of the window before poking his right eye and knocking a contact lens out. The father said Emmert-Stamm threatened to kill him throughout their altercation, court documents show.
The victim recalled exiting the residence as he attempted to get away from his son. He said his son followed him outside and allegedly attacked him with a six-by-six wooden post. Shortly after that, Stamm allegedly charged him.
The father said he then entered his truck "for protection" before he said Emmert-Stamm struck it with his vehicle. He said he was nearly struck by his son's vehicle. Emmert-Stamm then allegedly drove south on Traditions Pass, passed Shirk Way, turned around to head northbound and allegedly crashed into the driver's side of his father's truck.
The father said Emmert-Stamm reversed his vehicle and allegedly rammed into his trailer again. The officers then arrived on the scene a short time later.
The officers reported that the front and rear driver's side of the doors were "caved in," while the passenger side wheel was deflated and the rim was damaged. The trailer sustained a flat passenger side tire, a dented driver side wheel well and a damaged driver side taillight.
Next steps
Online court records indicate that Emmert-Stamm appeared in the Johnson Circuit Court on Monday morning for an initial hearing. Online records confirm Stamm entered a $3,000 cash bond to the clerk's office on Monday after the court issued a No Contact Order.
