BEECH GROVE, Ind. -- A man has been charged with neglect of a dependent and other felony counts after police say a 2-year-old consumed his THC gummy.
Court documents show that Labron Walker faces the following preliminary charges:
- Neglect of a Dependent (Level 5 Felony)
- Neglect of a Dependent (Level 6 Felony)
- Two counts of Resisting Law Enforcement (Class A Misdemeanor)
- Possession of Marijuana (Class B Misdemeanor)
- Possession of Paraphernalia (Class C Misdemeanor)
An investigation into Walker was launched on July 10 when officers with the Beech Grove Police Department were called to the 4600 block of Nikki Drive in response to a reported overdose involving a 2-year-old child.
Officers arrived and immediately observed a child who appeared to be "extremely lethargic" and was seen "visibly shaking." Police then spoke with a witness who said the child woke up around 8 or 9 that morning but went back to bed for several more hours until the early afternoon, which they noted as unusual behavior.
Court documents show that Walker realized that a THC gummy was missing from his bedroom. Walker reportedly told officers that he received the gummy from a "friend" at his work and confirmed the gummy contained around 20 mg of THC.
Walker shared that he left the gummy on a dresser in his bedroom and conceded that the child could have reached the gummy. The witness told officers that they were unsure how the child got hold of the gummy, as they would not have been able to reach the top of the dresser as Walker claimed.
The witness also recalled seeing the child's hands tremble as they were trying to eat and immediately contacted Poison Control as soon as they learned that the child possibly ingested the gummy.
After speaking with Walker and the witness, emergency medical personnel transported the child to Riley Hospital for treatment. The victim was reported to be in stable condition.
A representative with the Indiana Department of Child Services confirmed the child tested positive for cannabinoids and was held for observation for several hours. Court documents also revealed that the victim was "twitching" during the EMS ride and was "only responsive when prompted."
Following this, police returned to the apartment to conduct a search and confirm that there were no additional narcotics inside. When they arrived and explained that they needed to speak with Walker, he allegedly told them to "get a warrant."
While officers remained outside the residence waiting for a detective to obtain a search warrant, Walker reportedly exited with a red backpack as he attempted to enter an Uber that was waiting for him.
Officers approached Walker and made multiple verbal commands for him to remove his backpack and walk toward them. Court documents claim Walker ignored these instructions and allegedly put his right hand in his pocket. At that moment, one of the officers pushed him against the hood of a nearby car.
Walker allegedly continued to resist for several minutes. Police finally managed to detain Walker. While on the ground, one officer struck Walker two times, fearing that he was reaching for a firearm.
Once Walker was placed in handcuffs, police searched his backpack where they allegedly seized multiple bags containing an estimated 24 grams of marijuana, two suspected marijuana vapes, a fully loaded Taurus 9mm pistol, several rounds of ammunition, a cell phone, two trays, a reflective vest, two ashtrays and 10 cigarillo packs.
Police proceeded to execute a search warrant inside the residence, where they reportedly located a "small amount" of marijuana inside a clear bag sitting on the bottom shelf of a TV console in the living room. Police also discovered a digital scale, a glass pipe and a black bag with "green residue."
Walker was placed under arrest and transported to the Marion County Jail. Online court records indicate he is scheduled to appear in Marion Superior Court 30 on Thursday for an initial hearing in the case.
