
INDIANAPOLIS - Jurors convicted a Marion County man in a child molesting case in which he repeatedly victimized a minor over the course of four years.
Jose Alvuaiza-Alcantara was found guilty on five counts, including three Level 1 felony counts of child molesting and Level 4 felony counts of child molesting and sexual misconduct with a minor.
Jurors handed down the verdict on Wednesday.
The Marion County Proseuctor's Office filed the case in February 2023 after the victim came forward, leading to an investigation by the Indianapolis Metropolitan Police Department.
The girl, who was 14 years old at the time she reported the abuse, said Alvuaiza-Alcantara had been inappropriately touching her and forcing her into sex acts since 2018.
The abuse happened at two different homes from 2018 to 2022, according to court documents. It included sexual touching and proceeded to intercourse, when Alvuaiza-Alcantara forced himself onto her.
The girl's siblings observed some of the incidents, according to court documents.
During many of the encounters, the girl said Alvuaiza-Alcantara was intoxicated, and she could smell the odor of an alcoholic beverage emanating from him.
The girl said the abuse started when she was 9 years old and estimated that it continued until she was in her early teens.
During his interview with police, Alvuaiza-Alcantara denied the allegations. He maintained they had a good relationship and couldn't explain why she or her siblings would lie about the allegations.
He then told police the girl was "not right in the head" and suggested she "may have dreamt" about what happened. He also claimed the girl accused him of molestation when she was 9 years old, leading to a hospital examination and a formal report. He told police the girl later recanted the allegations.
Police could find no documentation to back up Alvuaiza-Alcantara's claim, according to court documents.
A Level 1 felony carries a sentence between 20 and 40 years in Indiana. A Level 4 felony carries a sentence between 2 and 12 years. A sentencing hearing is scheduled for May 12.
