IMPD 'disappointed' with sentence handed to man who struck officer with car


INDIANAPOLIS - A man has been sentenced to seven years in prison for striking a member of the Indianapolis Metropolitan Police Department with a car.




According to a press release from the Marion County Prosecutor's Office, Terrance Shane's sentence will be executed by the Indiana Department of Correction. Earlier this year, he pleaded guilty to possession of a narcotic drug and battery by means of a deadly weapon, which are Level 3 and Level 5 Felonies, respectively.




Court records indicate Shane also faced one count of battery against a public safety official - a Level 5 Felony. That charge was ultimately dismissed as the case played out in court.




The prosecutor's office indicated that the maximum sentence Shane could've received under his plea deal was 10 years in prison. Though prosecutors pursued the maximum sentence, the court ultimately settled on seven years in prison for Shane.




Per MCPO, Shane will also be on probation for two years after he is released from prison.




IMPD responded to the sentence Shane received via a post on social media Monday night:




"While we respect the judicial process, we are disappointed in the sentence today. We believe that those who attack our officers should be held fully accountable and face maximum penalties allowed under the law. The fact that this sentence is not consecutive adds no additional time for the defendant's reckless behavior, which could have killed our officer, who was just trying to do his job.




"This incident is a reminder of the dangers our officers face each and every day. They respond to unpredictable, often volatile situations with courage and professionalism, never knowing what they may encounter. We should all be thankful for these men and women. While today's sentencing may not bring the level of accountability we had hoped for, we remain focused on our mission to serve and protect our city with integrity and compassion. Despite this disappointment, your IMPD will be out in our communities today and beyond.




"(We) want to thank the Marion County Prosecutor's Office, our detectives, Indianapolis Emergency Medical Services (IEMS) medics, our public safety partners, and all of the officers who responded to the scene that night. We also remain grateful to our community for their continued support of our officers."




Details on incident involving Shane





Previous reporting indicates Shane struck an officer with a car on Nov. 14. Police were originally called to the scene because employees at a CVS on Meridian Street had found the then-36-year-old Shane unresponsive in their parking lot.




When police made it to the parking lot, they knocked on the window of the vehicle Shane was in, shined flashlights inside the car and activated emergency sirens to try to get him to respond.

IMPD reported that, after four minutes, officers made contact with Shane when he rolled the car's window down. Once Shane rolled the window down, police asked him to put the car in park and unlock it.




After Shane unlocked the car, police opened its passenger side door and asked Shane if he was OK. Police later asked Shane to exit the vehicle, and he complied with the officers' request.




IMPD reported that its officer told Shane to walk toward the back of the vehicle so they could make sure he was alright. At that time, Shane reportedly tried to get back into the car.




When Shane tried to re-enter the vehicle, an officer grabbed his arm and told him to exit the car. After the officer grabbed Shane's arm, Shane put the vehicle in reverse and pinned the officer between the car and the wall of the CVS.








After Shane struck one officer with the car, another cop shot him. Shane complied with police's orders to exit the vehicle after he was shot.




IMPD reported that Shane lay on the ground after he got out of the car. Police then handcuffed him and applied a tourniquet to his arm.




IEMS medics, who were staged at the scene prior to the shooting, pulled the officer who was hit by Shane to safety. The officer was then transported from the scene to a local hospital in good condition.




Shane was also taken to a hospital in stable condition after he was shot.




IMPD reported that the officer who shot Shane was placed on administrative leave after the shooting. No formal updates on that officer's status had been made available as of this article's publication.




Police also indicated that officers' bodycams were activated during their encounter with Shane.




IMPD's internal affairs unit investigated the incident. Police also reported that a civilian-majority use-of-force review board will examine the incident now that criminal proceedings have concluded.
