Wrongful death lawsuit filed against IMPD after man killed by officer's car in 2023
INDIANAPOLIS -- A wrongful death lawsuit has been filed in Marion County against the Indianapolis Metropolitan Police Department after 34-year-old Joseph Stiger was struck and killed by an officer's squad car in August 2023.
According to court documents filed earlier this month in Marion County, the lawsuit was brought forward by a representative of Stiger's estate against Mark Brown, the IMPD officer who hit Stiger, as well as IMPD, the city of Indianapolis and another involved driver.
On July 31, 2023, Brown struck Stiger near the 3300 block of East 10th Street while responding to an incident on the east side of Indianapolis. According to previous reports, Stiger was initially in critical condition but was later pronounced dead at an Indianapolis hospital.
Previous reports indicate that Brown was responding to a domestic disturbance with a possible home invasion. As Brown's vehicle approached the intersection of E 10th St. and N. Lasalle St., he reportedly activated his sirens and lights.
Brown was disrupted by a vehicle attempting to make a left turn. As Brown attempted to pass the vehicle, Stiger approached the police vehicle while biking west on 10th Street. The two then collided.
The lawsuit, brought forward pursuant to the state's Adult Wrongful Death Act, claims that Brown "operated his motor vehicle in an unreasonable and unsafe manner" that ultimately caused the collision.
The lawsuit also claims that the collision was directly caused by the carelessness of Brown, as well as the driver attempting to make a left onto Lasalle Street.
Stiger's estate is asking for a jury trial in this case. Ultimately, the estate is seeking medical expenses, as well as funeral/burial expenses, estate expenses and attorney's fees.
