According to court records, 63-year-old Michael Fergerson was run over by an IndyGo bus in September 2018. Fergerson sustained serious injuries to his feet, legs, abdomen and chest and was transported to an area hospital in critical condition after the accident. Fergerson did not survive his injuries and died at a local hospital two weeks after the incident. Legal proceedings In October 2019, Fergerson's family filed a lawsuit against IndyGo and the bus driver involved in the incident. After a three-day trial, a jury awarded Fergerson's family $6 million in damages. IndyGo appealed the trial court's decision, and an appeals court later reversed the trial court's actions. Fergerson's family then petitioned for a transfer, which the Indiana Supreme Court granted, thus vacating the appeals court's decision. IndyGo initially appealed the trial court's opinion because it did not believe its driver was solely responsible for the fatal accident. IndyGo's legal team contended that Fergerson's medical conditions played a role in his death. Events that led to Fergerson's death Court records indicate Fergerson suffered from sciatica and alcoholism. On the day of the deadly accident, Fergerson had been hospitalized because he had consumed a half-pint of vodka and displayed "confused" and "uncoordinated" behavior. During his stint at the hospital, Fergerson reportedly told staff he drank a pint or half-pint of vodka daily. Fergerson was ultimately released from the hospital. His family indicated that he visited a grocery store sometime after he got out of the hospital. After his trip to the grocery store, Fergerson, made his way to a bus stop with grocery bags in his hands. Per court records, one bus driver pulled up to the stop and saw Fergerson sitting there. That driver denied Fergerson access to the bus because they saw a bottle of liquor in his hand. Indiana law prohibits Hoosiers from riding buses while intoxicated. Court documents indicate Fergerson appeared to be "mildly intoxicated" after his release from the hospital. A second bus later pulled up to the stop Fergerson was sitting at. When the bus initially arrived at the stop, Fergerson remained seated on a bench. As two passengers got off the bus, he slowly stood up with his grocery bags and headed toward the bus doors. According to court records, just before Fergerson reached the bus, it began to move. As the bus pulled away, Fergerson either reached toward it or stumbled with an arm outstretched for balance. Court documents indicate Fergerson's arm hit the bus, and he was spun around by the contact. Fergerson then fell from the sidewalk and was run over by the rear wheels of the bus. Fergerson's official cause of death was deemed "complications from blunt force trauma." Medical examination also revealed that Fergerson's blood alcohol content was .261 at the time of the accident. Jury trial arguments IndyGo argued that Fergerson's intoxication rendered him negligent in his own death to some degree. The jury that first heard that case disagreed with IndyGo's assertion and ruled in favor of Fergerson's family. Among the relevant testimony the jury heard was that of Dr. Robert Gregori, the expert physician of Fergerson's estate. Gregori explained to the jury that alcoholics "develop a higher-than-average tolerance" for liquor. Gregori added that a BAC exceeding .300 "may not affect an alcoholic like it would a person who is not used to drinking heavily." Fergerson reportedly called his mother before he attempted to board the bus. During legal proceedings, Fergerson's mother contended that he did not appear to exhibit any signs of severe intoxication while they were on the phone - though she did concede that Fergerson had likely been drinking alcohol the day of the accident. IndyGo's expert toxicologist told the jury Fergerson still would have exhibited signs of intoxication with a BAC of .261 - even if he was an alcoholic. During the trial, attorneys for Fergerson's family also argued that Fergerson's alcoholism may not have played a role in his death because he had likely boarded buses while intoxicated many times without issue. Court records indicate IndyGo's bus driver did not see Fergerson during the accident. The driver indicated that he checked his mirrors for a "split second" before pulling away from the stop. The driver said he did not remember if he had properly aligned the bus' mirrors. The driver also said he could not remember if he approached the stop at distances required by IndyGo policy. Fallout After the jury awarded Fergerson's family $6 million in damages, IndyGo appealed the jury's decision on the grounds that the jury had made an erroneous decision that did not have due regard for the evidence that was presented during the trial. An appeals court agreed with IndyGo's argument, but the Indiana Supreme Court disagreed with IndyGo in a 3-2 decision, allowing the trial court's initial ruling to stand and vacating the appeals court's decision. Chief Justice Loretta H. Rush, Justice Christopher M. Goff and Justice Derek R. Molter agreed with the trial jury's ruling. Justice Geoffrey G. Slaughter and Justice Mark S. Massa dissented. Indiana's statutory limits will prevent Fergerson's family from receiving the $6 million it was awarded during its jury trial. Instead, the family will receive $700,000 in damages. In a portion of its opinion, the Supreme Court mentioned that it found it difficult to overturn the trial court's decision because attorneys for both IndyGo and Fergerson's family had both commended the attentiveness of the jury involved in the trial. "To be sure, this is a close case," Rush wrote in the court's official opinion. "But our role is not to stand in the place of the factfinder. Instead, we are confined to determining whether, considering the evidence in the light most favorable to the Estate, the only reasonable inference is that Fergerson was contributorily negligent. On this record, we cannot reach that conclusion. Six jurors, who were most attentive and asked the most questions either party's attorneys had ever seen, did not find that Fergerson was contributorily negligent. "And that jury was properly instructed on contributory negligence and the two statutes on which IndyGo relied, which we presume the jury followed. Additionally, both the trial court and the judge of our Court of Appeals found that IndyGo did not establish Fergerson was contributorily negligent as a matter of law. "Judge Benjamin went through and listed all the ways in which the defense was denied exculpatory evidence in the course of the investigation of the case leading up to trial and then even after the trial occurred that things were still not given to them," said Villanueva after reading the judge's opinion. In an 83-page ruling, under consideration since a hearing for Petition for Post Conviction Relief last February, Judge Benjamin found that Columbus police repeatedly ignored leads that indicated Michael Dean Overstreet, convicted in the 1997 killing of Franklin College student Kelly Eckart, was also suspected of killing Myers, and CPD's and The Bartholomew County Prosecutor's refusal or inability to turn over significant exculpatory evidence violated Rules of Discovery and jeopardized Hubbell's right to a fair trial. "These were things that were discussed in the judge's order that his original trial counsel had specifically asked for and they were simply not given to him," said Villanueva. "It's always better to hand that stuff over and deal with how it impacts the case later on than to not let that get out there." More than a dozen times throughout her ruling, Judge Benjamin wrote that the exclusion or non-disclosure of several pieces of information was "suppressed by the State and favorable to Hubbell." Some of that information included similarities between the Myers and Eckart murders, Overstreet's claim to an acquaintance that he was having an affair with a woman named Sharon in Columbus that resulted in the birth of a child three months before the killing, that he was on his way to Arvin Industries, Myers' place of work, to apply for a job the morning she disappeared and returned home that night "covered in blood," witness accounts of a man who resembled Overstreet with Myers, Overstreet's familiarity with the Camp Atterbury wilderness where both Myers and Eckart were killed and the Myers abduction van similar to a vehicle driven by Overstreet. Hubbell was convicted based on carpet fiber evidence, an uncertain alibi at the time of Myers' abduction, his employment at Arvin Industries and shaky testimony by uncertain witnesses and persons facing their own criminal charges. Judge Benjamin blamed "tunnel vision" for "CPD withholding material exculpatory evidence that either implicated Overstreet in the Myers' homicide and/or linked Overstreet to Myers," and that a detective's file was incomplete and "had all the information pertaining to Overstreet removed. This Court does not find that to be a coincidence." The judge found the detective "intentionally failed to truthfully inform (Hubbell's trial attorney) of the information he was aware of linking Overstreet to Myers and implicating him in Myers' murder as an alternate suspect," and that the officer's "testimony was misleading." "I think probably the most troublesome fact was one of the investigators who was involved in the case that seemingly withheld some important information," said Villanueva. "You do have people who are involved in the case still around, maybe some of these investigators, based on this judge's finding, their testimony is now tainted. Their credibility is greatly damaged by things that they said and did under oath." Villanueva said the prosecutor will also face an uphill climb in resurrecting an investigation going back to 1997. "Its almost like a Mount Everest, it really is," Villanueva said. "You're gonna have issues with witnesses, people maybe have passed away, maybe they've moved away, you can't find them anymore. For those you can find, maybe their memory isn't what it used to be. They don't record the events as well." Much of the new evidence was discovered by Hubbell, who continued to work on his case from behind bars at the Pendleton Correctional Facility with the assistance of the Notre Dame Exoneration Justice Clinic. In her ruling, Judge Benjamin wrote, "The State's failure to disclose the material exculpatory evidence undermines the confidence in Hubbell's guilty verdict and deprived Hubbell of his right to a fair trial." The judge's decision does not find Hubbell not guilty, merely that his attorneys were denied information that could have been used to argue for a jury acquittal based on reasonable doubt. Bartholomew County Prosecutor Lindsey Holden-Key last month refused comment on the pending case. Judge Benjamin has set a hearing for Oct. 2 to determine if the prosecutor will appeal her ruling, seek a new trial, ask for more time or agree to set Hubbell free. Lisa Davis told FOX59/CBS4 that, even though her brother has served nearly half of a 75-year prison sentence for a murder he claims he did not commit, Hubbell does express sympathy for the Myers family. Davis said she is looking forward to bringing her brother home. According to court records, the suspect initially claimed the fatal stabbing was in self-defense, but she later confessed she was not in fear for her safety; she was simply enraged. Less than 15 minutes after being driven to Community East Hospital by his domestic partner and two good Samaritans, 20-year-old Breyner Perez Matute died from a single stab wound to his chest early Saturday morning. Police quickly learned the stabbing took place at an apartment complex on Shortridge Drive, directly behind IMPD's East District headquarters. Mirla Gonzalez-Palma, 31, also known as Milla, told police she got drunk and stabbed her partner after he hit her during an argument. Mirla Gonzalez-Palma "Unfortunately, individuals involved in this lost their temper and both parties may have done so, it's believed that by detectives," said IMPD officer Tommy Thompson. According to the affidavit filed by police, the suspect confessed she was drunk, enraged, offended and wanted vengeance. She even admitted that after the victim hit her, he tried to be reasonable with her, but it was just too late. In the end, Gonzalez-Palma said she was sorry and she didn't intend to kill him. "We have to know when to walk away and take a deep breath," said Thompson. For their part, IMPD praised witnesses at the apartment complex, including the suspect's 12-year-old son, for assisting the investigation. One neighbor said she saw the suspect trying to drag the victim to the car. The suspect was yelling at the victim, "Don't die," and told witnesses, "He hit me." Police again urge everyone to settle their conflicts without resorting to violence. "We need the community to think twice with their actions. When you're in a hostile argument, maybe it's turning physical, you have to be able to walk away and get to a safe place. If police are needed, contact the police," said Thompson. Jail records show the accused killer is being held on a federal detainer from Venezuela, although the prosecutor's office noted given the severity of the murder allegation, Gonzalez-Palma's immigration issue may have to wait until the criminal case is concluded. In addition to the federal detainer, the suspect is being held without bond pending the filing of formal charges. According to court documents, 36-year-old Jacob Cram was taken into custody on murder charges in Boone County after the reported incident on Sept. 10. On the evening of Sept. 10, an officer with the Lebanon Police Department was approached by two individuals who said that Cram reportedly killed Donald Bowers. In an interview with one of the witnesses, he reportedly told officers that he saw Cram attempt to hang a blanket over a door inside a Lebanon home. At the time, the witness reportedly was initially stopped by Cram, saying "I can't show you," then stated, "Oh, well, I guess I can." The witness then reportedly saw the owner of the home, identified as Bowers, on the ground with his head wrapped in duct tape and a screwdriver sticking out of his head. At this time, Cram reportedly told the witness to "not... tell anyone what he had seen." Suspect arrested on murder charge after man found dead inside Lebanon home </a> After the initial report, Lebanon police officers responded to the home and found Bowers' body. As part of the investigation, officers were told by another witness that Cram's last known location was inside Bowers' home with Bowers. Cram was eventually taken into custody. During an interview, Cram reportedly confessed to killing Bowers, stating that he tried multiple different ways of killing Bowers, including striking him with a broom handle, cutting Bowers with a box-cutter and wrapping a blanket around his face. Cram reportedly told police that during the multiple attempts to kill Bowers, Bowers was reportedly fighting back. Joseph Bilbrey, 39, was charged with the following offenses: <ul> Two counts of Child Molesting, a Level 1 Felony</li> Performing Sexual Conduct in the Presence of a Minor, a Level 6 Felony</li> Child Molesting Fondling, a Level 5 Felony </li> Two counts of Child Solicitation, a Level 5 Felony </li> Child Molesting or touching child under 14, a Level 4 Felony</li> Child Seduction, a Level 1 Felony </li> Voyeurism, a Level 6 Felony </li> </ul> Officers were dispatched on Saturday, Dec. 28, 2024, to N 300 W in Greenfield on a report of voyeurism and child molestation involving a juvenile. According to court documents, a juvenile victim allegedly found a camera in the bathroom at a birthday party. After telling an adult, the victim reportedly was angry and broke the SD card. The video was not able to be restored, however an interview ensued. The interview led to the 14-year-old victim saying that she has been sexually attacked by Bribley for at least 6 years. Significant amounts of information are redacted to extremely explicit content. This is an active investigation. According to a post on social media from the Indianapolis Metropolitan Police Department, an IMPD officer was patrolling the downtown district just before 5 a.m. on Sunday. The officer reportedly observed a vehicle commit two traffic violations, causing the officer to pull it over. The post read that the four occupants of the vehicle provided the officer with their names during the traffic stop. One of the passengers of the vehicle, identified by IMPD as an 18-year-old, was confirmed to have an active arrest warrant for felony murder and robbery charges. Man shot and killed on Indy's near south side </a> The charges were in relation to a reported fatal shooting that stemmed from a robbery on the near south side of Indianapolis in October 2024. According to <a href="https://fox59.com/news/indycrime/man-shot-and-killed-on-indys-near-south-side/" target="_blank">previous reports</a>, officers were called to the 300 block of Park Haven Way on a report of a shooting. The man who was shot, identified as 26-year-old Jose Hernandez, was taken to a local hospital in critical condition. Hernandez was later pronounced dead. As an investigation into the incident continued, detectives found that Hernandez was shot during a reported robbery. Two suspects were identified in this incident, including 33-year-old Brittany Norton and the unidentified teen, who was taken into custody on Sunday by IMPD. Norton was arrested on Jan. 3 on her active warrant for the charges of murder and robbery. The eastbound I-465 ramp to southbound Binford Boulevard closed as part of the ongoing Clear Path 465 project. It reopened around 5:30 a.m. Monday. In order to get the area ready, crews closed down some nearby roads and instituted lane restrictions over the weekend. The approximately two-month-long closure allowed crews to reconstruct Binford Boulevard to separate local traffic from traffic entering and exiting I-465 and I-69. Crews were also able to move a concrete barrier in the area. Image via INDOT Traffic is now moving on the new bridge. Drivers should look for a temporary traffic signal on southbound Binford Boulevard north of 75th Street. It's intended to manage traffic on southbound Binford Boulevard from I-465 and I-69. The Clear Path 465 project aims to improve safety and traffic flow along the busy interstate corridor on the northeast side. It includes added travel lanes, modifications to interchanges, more than a dozen new bridges, pavement replacement and maintenance. The Indiana Department of Transportation said multiple ramps and bridges should be finished by the end of the year, including the ramp from 56th Street to northbound I-465, the ramp from Allisonville Road to eastbound I-465, several bridges and full access to I-69, I-465 and Binford Boulevard from 82nd Street. Construction started in early 2022. The Colts are now 2-0 for the first time since 2009. Shrader missed a 60-yard attempt, but the Broncos were flagged for leverage. The penalty moved the kick 15 yards closer and the second-year kicker didn't miss his second chance. The Colts' offense picked up where it left off last week against Miami. Daniel Jones connected with Josh Downs for 19 and 10 yards, then hit Michael Pittman Jr. for another 10 yards with 15 yards tacked on for roughing the pass to move into field goal range. Shrader made a 29-yard field goal for the early 3-0 lead. The scoring drive marked eight straight possessions with points to start the season. Denver answered with a 6-play, 64-yard drive capped by a Bo Nix to Marvin Mims Jr. 23-yard touchdown to give the Broncos the lead. The Colts made it nine straight possessions with points as Shrader kicked a 33-yard field goal to cut Denver's lead to 7-6. The highlight of the drive was a Jones to Tyler Warren 41-yard gain. The Colts' defense forced the first punt of the game and the offense went right back to work as Jones hit Jonathan Taylor for a 43-yard gain down to the Broncos' 11-yardline. Jones finished the drive with a one-yard touchdown plunge, his third rushing touchdown of the season to put the Colts back on top, 13-7. Denver responded behind Nix and wide receiver Tony Franklin. According to the Indianapolis Metropolitan Police Department, officers were called to the intersection of East 43rd Street and North Meridian Street around 4:04 p.m. to investigate a crash. When police arrived at the scene, they found two cars that appeared to have been involved in the crash. Upon further investigation of the crash scene, police located a person who had been ejected from one of the vehicles involved in the crash. That individual was transported from the scene to an area hospital in critical condition. In an update sent Sunday evening, IMPD confirmed that the person who was ejected from a car during the crash had died at the hospital. Police believe the crash occurred when the driver of a vehicle that was travelling southbound on North Meridian Street collided with a car that was moving westbound on East 43rd Street. IMPD investigators believe the decedent was a passenger in the vehicle that was travelling westbound on East 43rd Street when the crash occurred. Police do not believe intoxication was a factor in the crash. The drivers of both vehicles involved in the crash were subjected to blood draws in compliance with IMPD's standard procedure for fatal crash investigations. IMPD's report on the crash indicates a 2018 Ford and 2005 Toyota were the vehicles involved in the crash. The report also shows that multiple individuals witnessed the crash. According to the Grant County Sheriff's Office, at approximately 8:46 p.m., deputies received calls in reference to a traffic accident involving multiple vehicles on State Road 9 at Meridian Street on the north side of Marion. After deputies arrived on scene, they determined four vehicles were involved in the crash with multiple injuries and at least one entrapment. The injured were transported to an area hospital for treatment. A 57-year-old Marion woman was airlifted to a Fort Wayne hospital where she died, police said. Investigators believe three of the vehicles were traveling southbound on State Road 9, and one was northbound. A southbound vehicle slowed to make a left-hand turn onto Meridian Street. The same vehicle was rear-ended causing it to spin into the opposite lane where it was struck by a northbound vehicle, causing it to spin again into the path of another southbound vehicle, police said. No additional information was released. Fire crews stopped the flames from spreading to a nearby house, but the damage to the barn is devastating. "Our family has been farming here since 1820," Hawk said. "So, there was a time when I was watching it burn, and I was like 'Is this the end of Arnold Family Farm right now?' And that was really, really difficult to even contemplate." The family's grain mill, tractors and harvesting equipment were inside the barn when it caught fire. "It's also where we washed and packed all our vegetables, so all of our sinks and our walk-in cooler (were in there)," Hawk said. Although the aftermath is hard to see, Hawk said no one was hurt, and the barn cats were able to escape. "It's things that we lost, which is awful for our business, but we'll rebuild," Hawk said.&nbsp; The family is left wondering what the rebuilding process will look like, but is grateful for ongoing community support both in and out of Rushville. They sold produce at Garfield Park Farmer's Market on Saturday as usual. Without a tent and tables, Hawk said others stepped in to help them set up. Emotional customers made donations to help cover the damage. "We've gotten so much support from our community that we're really determined to build it back and to make sure that we can keep farming," Hawk said.&nbsp; The Rushville Township Fire Department was not available to answer questions about the cause of the fire. Bentonville Volunteer Fire Department Chief Chad Ripberger said his department, Glenwood Fire and Raleigh Fire helped Rushville Fire put out the flames. They opened their run to Super Bowl XLIV with 14 straight victories. Peyton Manning led the Colts to a 2-0 start six times. The only other quarterback to achieve a 2-0 start in the Indy era: Jim Harbaugh in 1996 (4-0). By the way, the last time the Colts opened 2-0 with consecutive home wins was in 1960. <strong>History lesson, Part II</strong> The overall series is tied 15-all. The Colts have won 10 of the last 13 meetings, but Denver won the most recent. Surely you remember last December at Empower Field at Mile High? Indy was in position to take a 20-7 third-quarter lead in a game with serious playoff ramifications, only to see Jonathan Taylor's 41-yard touchdown turn into a lost fumble when he dropped the football short of the goal line. That, along with an ill-advised throw-back pass by AD Mitchell that Nick Bonitto returned for a 50-yard fumble return/TD, contributed to Denver's 31-13 victory. <strong>Daniel Jones, Act II</strong> The offense scored on all seven possessions, the first time that's happened in the NFL since at least 1978. Credit Jones. In his first start for the Colts, he was decisive, efficient and generally found the right receiver in stride. He completed 22-of-29 passes - the 75.9% is the 6th-best in his career with at least 20 attempts - for 272 yards and a TD. He also rushed for two TDs, becoming just the sixth player in NFL history with at least 250 passing yards and two rushing TDs in a season opener. He joined an illustrious group: Josh Allen, John Elway, Troy Aikman, Otto Graham and Jim McMahon. Nice game. Now, do it again. "I think once you have that, you move on,'' Jones said. "It's week-to-week. This is the NFL, so you've got to put that behind you and prepare this week. Learn from what you didn't do as well, improve on that going into this week. I think we're all kind of in that mindset.'' Shane Steichen opted for Jones over Anthony Richardson Sr. in large part because of his consistency. That means stacking solid games. The last time Jones won consecutive starts was weeks 4-7 of 2023. The only time he's passed for at least 270 yards in back-to-back games: the final two games of his rookie season in 2019. <strong>More from the offense</strong> Jones probably benefitted from the best supporting cast of his career. Pass protection allowed just two hits and one sack. Seven different players caught at least one pass and the Taylor-led run game churned out 156 yards. The offense faces a stiffer challenge Sunday. The Broncos ranked 3rd&nbsp;in fewest points last season (18.3 points per game) and took an authoritative step into 2025 against the Tennessee Titans. They harassed No. 1 overall pick Cam Ward with six sacks and eight other hits and limited the Titans to a league-low 133 yards, 2.4 yards per play, no TDs and four field goals. Six different Broncos produced a sack, including end Zach Allen, who had five hits on Turner, and Bonitto, who had two tackles for loss and three QB hits. Another catalyst is cornerback Patrick Surtain II. The reigning Defensive Player of the League and two-time first-team All-Pro is capable of locking down one side of the field. That's where Jones must recognize where the football needs to go. Against Miami, he primarily targeted rookie tight end Tyler Warren (nine) and Michael Pittman Jr. (eight). If Denver takes them away, Jones must look more to Josh Downs and Mitchell. We're interested in what Warren has for an encore. His first pro game included seven catches for 76 yards and one rush for 3 yards that converted a third-and-short. Bo Nix led Denver to the playoffs as a rookie by passing for 3,775 yards and 29 TDs and rushing for 430 yards and four more TDs. Nix wasn't dominant against the Titans, passing for just 176 yards and one TD while suffering two interceptions. He also lost a fumble. Denver, though, isn't a one-man show. Courtland Sutton is one of the most prolific receivers in club history, and opened with six catches for 61 yards and a TD against Tennessee. The backfield tandem of rookie RJ Harvey and vet J.K. Dobbins combined for 133 yards on just 16 carries. <strong>Defensive hurts</strong> The task of dealing with Nix and Denver's passing game is more complicated with Charvarius Ward (concussion) and <a href="https://fox59.com/sports/colts/colts-place-cb-jaylon-jones-on-ir/" target="_blank">Jaylon Jones</a> (on IR with a hamstring) out of the mix. Ward undoubtedly would have been assigned to Sutton. Now, the load must be shared by Kenny Moore II, Xavien Howard, Mekhi Blackmon and rookie Johnathan Edwards. Blackmon, who was acquired in a trade with Minnesota in late August, probably starts for Ward. Coordinator Lou Anarumo might want Moore to focus on his nickel duties. <strong>And the winner is: Colts 24, Broncos 21</strong> This figures to be markedly more difficult than last week's dominance of a wavering Dolphins bunch. Denver appears to be the real deal. But the opportunity's there for Indy to establish itself early in the season, especially with the first two and four of six at Lucas Oil Stadium. What struck us about the blowout of Miami was that the Colts didn't do anything extraordinary. They were sound in all three phases. Do it again.
