2. In my communication with others how may I identify myself as a BlackVibes.com Affiliate? |
| You may describe yourself as a participant in the "BlackVibes.com Affiliate Program." Your communication must clearly and accurately describe the nature of your participation in the BlackVibes.com Affiliate Program and must not create confusion or misrepresent the nature of your or any other party's participation in Program. You may, without our prior consent, say the following in any non press release communication: that you have become a BlackVibes.com Affiliate, and/or that you have joined or become a member of the BlackVibes.com Affiliate Program. You may also describe the BlackVibes.com Affiliate Program as "one of the leading selling programs on the Internet for music enthusiasts of all interests and backgrounds." |
3. In my communication with others may I use any other terms to describe my standing as a BlackVibes.com Affiliate? |
| In all promotion, in the context of describing the BlackVibes.com Affiliate Program or your relationship with the Program or BlackVibes.com, you must clearly represent yourself and your site as entities independent from BlackVibes.com, the BlackVibes.com site, and any of BlackVibes.com’s affiliated companies' Web sites. You may not use any of the following words: "network," "partnership," "reseller," "alliance," or "relationship agreement," or any other words which may lead one to confuse the Program with any other selling initiatives. |
4. May I include a reference to BlackVibes.com in a press release? |
| No. You may not include a reference to BlackVibes.com in any press release with respect to the Terms of Service and Conditions of your participation in the Affiliate Program. |
5. What is your policy on unsolicited commercial e-mail? |
| To protect the integrity of the reputation of Blackvibes.com Affiliates as well as the BlackVibes.com brand name, you may not promote your site via certain forms of indiscriminate advertising, commonly referred to as "spamming." Accordingly, you may not promote your site via unsolicited commercial e-mail (UCE), postings to non-commercial newsgroups, or cross-postings to multiple newsgroups at once. In addition, you may not promote your site in any way that effectively conceals or misrepresents your identity, domain name, or return e-mail address. |
6. May I notify others via e-mail about my participation in the BlackVibes.com Affiliate Program? |
| You may promote your site via mailings to recipients who are already customers or subscribers to your sites' services, provided that the recipients have the option to remove themselves from future mailings. Further, you may promote your site via newsgroup postings that specifically welcome commercial messages (consult the newsgroup FAQ or moderators to be sure that such a message is acceptable in that newsgroup). |
